Notice of Default:

The pre-foreclosure process begins when home owners receive a notice of default (NOD), because they have missed mortgage payments. Lenders assign a "trustee" as the Grantor who is responsible to execute the foreclosure process. The Trustee sends out a Certified Letter notifying the borrower that they are in default. This notice can be sent as soon a payment is missed, but usually won't come until three or four months after the first missed payment.

At this point the house is not foreclosed, and you can make the loan current by paying all that is owed, plus any fees. Making the regular payment is not enough. All missed payments and fees must be paid in full. You have approximately 3-4 months to clear the default before the Foreclosure will actually take place.

Your lender may also give you an opportunity for Forbearance where they will "Modify the Loan" and the terms. This will place the notice of default on hold, but it will not be completely cleared.

Notice of Trustee Sale

If no steps have been made to sell the house, or bring the loan current the borrower will receive a "Notice of Trustees Sale." This notice is received approximately 3 months after the Notice of Default. The notice of trustee sale will be posted on the buyers property, delivered to the Cache County recorders office, and will run ads in the Herald Journal for 3 consecutive weeks.

If the home owner can not make up the missing payments, and the owners owe more than the homes market value, the home owner can often sell their house under "short sale status."

Trustee sales in Logan take place at the court house steps located at 135 N 100 W. This is a public auction, and anybody may bid on the house if; 1.They provide $5,000 certified funds prior to bidding. 2. Can pay the entire balance in full within 24 hours. Properties sold at the public auctions are sold as is and without warranties. At this point the prior home ownes will not only have the foreclosure on their credit, but they may also get a deficiency judgment showing that they still owe on any additional amount the lender did not recover.
